Terms of Services

GENERAL

• I, the artist, hold the right to the produced drawing, not the commissioner. That includes the rights to stream the art process, post WIPS on my social media, use it to promote myself, publish said art in a book and post or display it anywhere to my liking unless discussed beforehand.• Reference images or mood boards are required when you approach me for a commission. I do not work with word descriptions only unless its a design commission.• Work turn-around time varies depending on the complexity of the piece and my availability.• The commission will be drawn with my own art style. Please don't ask me to draw with a different art style.• I DO NOT allow my art to be sold as an NFT or be involved in any form of cryptocurrency transactions.• I can and I will decline commission requests when I see fit to it.• For personal use only. If you're looking to hire me for a commercial work, send me an email to discuss the details.• Maximum of 3 revisions ONLY on the sketch output. Not applicable to design commissions.• You can use the art however you like as long as it doesn't involve any commercial use and you do not claim that you did the artwork yourself.• If you're going to resell a design/Live2D Model with or without my rig, please ask me first. You are not allowed to resell it without my permission and for a higher price than you originally bought it unless it includes extra things. Please provide a concise list of everything that's to be resold.

PAYMENT

• If applicable with your commission, payment is required to be upfront via PayPal or GCASH (if you're a PH client).• I will not start working on the commission until the client pays in full or have finished their payment plan. If I have not started anything in maximum 4 weeks from the full payment I will be refunding the client their full payment.• If the client wishes to cancel their slot and I have already made some progress on it the refund will be depending on the progress and the inconvenience the cancellation will cost me.• A partial payment of 20% of the total price is required to sign up for a payment plan. If slot has been cancelled and a progress has been made from the partial payment it will no longer be refundable.• If client is signing up for a payment plan, the client will also have to cover the 5% fee that PayPal charges in each transaction.• Failure to pay the invoice within 7 days results to cancellation of your commission slot and will be automatically given to the next person. Please pay your invoices in time.• If something occurs that will cause delay on payment please tell me in advance, I may be able to give a 1-week extension depending on the reason.

PROCESS

• You will be notified once I start working on your commission thru the agreed communication platform.• Work In Progress (WIP) updates will be given if the commissioner asks for it otherwise WIP updates will depend on me, the artist.• I usually give WIP updates when I have progressed quite a bit since the last update I have given. Other than that I, the artist will give updates at least once a week.• Waiting time varies depending on my health, commission queue, complexity, work, family or personal issues. If something happens that may impede the process, client will be notified asap.• Deadline can be set at least a week prior to the deadline date and may come with an extra fee.• Please feel free to ask me for updates when I haven't updated you after a week.• Make sure to be familiarized with the estimated waiting time by asking me.

COMMERCIAL USE

• A commissioned art may only be used commercially if you've bought the corresponding commercial rights for its usage/purpose.• The prices of VTuber Model Art, Live2D Rigging and Streaming Asset commissions is already inclusive of the commercial fee/rights.• Using a commercially commissioned art not intended for the rights it was paid for is strictly prohibited.• Please be clear, honest and concise with what you want and your intended use for the commissioned art.

PRICE TIER

> 2x price, if you wish to post it anywhere without credit/my watermark - that includes streaming platforms.
> 3x price, commercial use, when the artwork brings you any kind of profit, but the art is not the main selling point.
(e.g., illustration to a book, game, book or CD cover etc.)
> 5x price, special commercial use, when you are going to sell merchandise of any shape or form using my artwork.
(e.g., stickers, keychains, prints, dakimakura etc.)
